Victoria online store regulations

I. Definitions

The terms used in the Regulations mean:

1. Customer - a natural person, legal person or an organizational unit that is not a legal person, whose specific provisions grant legal capacity, who places an Order within the Store;

2. Civil Code - Act of 23 April 1964 (Journal of Laws No. 16, item 93, as amended);

3. Regulations - these Regulations for the provision of electronic services as part of the Viktoriia online store;

4. Online Store (Store) - a website available at viktoriia.pl, through which the Customer may, in particular, place Orders;

5. Goods - products presented in the Online Store;

6. Sales contract - a contract for the sale of Goods within the meaning of the Civil Code, concluded between Viktoriia and the Customer, concluded using the Store's website;

7. Consumer Rights Act - the Act of 30 May 2014 on consumer rights (Journal of Laws of 2014, item 827);

8. Act on the provision of electronic services - the Act of 18 July 2002 on the provision of electronic services (Journal of Laws No. 144, item 1204, as amended);

9. Order - Customer's declaration of will, aiming directly at the conclusion of the Sales Agreement, specifying in particular the type and quantity of the Goods.

II. General provisions

2.1. These Regulations define the rules for using the online store available at viktoriia.pl.

2.2. These Regulations are the regulations referred to in art. 8 of the Act on the provision of electronic services.

2.3. The online store, operating at viktoriia.pl, is run by Viktoriia Tsyhan, running a business under the name Viktoriia Tsyhan, registered in the Central Register and Information on Economic Activity (CEIDG), NIP 1182261177, REGON: 525173620, run by the minister responsible for economy. Business address: Chmielna 2 lok. 31, 00-020 Warsaw.

2.4. These Regulations specify in particular:

a) the rules for registering and using the account as part of the online store;

b) terms and conditions for making an electronic reservation of products available in the online store;

c) terms and conditions for placing Orders electronically as part of the online store;

d) the rules for concluding Sales Agreements using the services provided as part of the Online Store.

2.5. Using the online store is possible provided that the ICT system used by the Customer meets the following minimum technical requirements:

a) Internet Explorer version 8 or newer with JavaScript enabled, or

b) Google Chrome, Opera, or Mozilla Firefox with JavaScript enabled,

c) minimum screen resolution of 1024 x 768 pixels.

2.6. In order to use the online store, the Customer should obtain access to a computer station or end device with Internet access on their own.

2.7. In accordance with applicable law, Viktoriia reserves the right to limit the provision of services via the Online Store to persons who are over 18 years of age. In this case, potential customers will be notified of the above.

2.8. Customers may access these Regulations at any time via the link on the main page of the viktoriia.pl website, as well as download and print it out.

2.9. Information about the Goods provided on the Store's websites, in particular their descriptions, technical and functional parameters and prices, constitute an invitation to conclude a contract, within the meaning of art. 71 of the Civil Code.

III. Rules for using the Online Store

3.1. The condition for starting to use the Online Store is registration within its framework.

3.2. Registration takes place by completing and accepting the registration form available on one of the Store's pages.

3.3. The condition for registration is consent to the content of the Regulations and providing personal data marked as mandatory.

3.4. Viktoriia may deprive the Customer of the right to use the Online Store, as well as limit its access to some or all of the Online Store's resources, with immediate effect, in the event of a breach by the Customer of the Regulations, and in particular when the Customer:

a) provided untrue, inaccurate or outdated data during registration in the online store, misleading or infringing the rights of third parties,

b) committed an infringement of the personal rights of third parties through the online store, in particular the personal rights of other customers of the online store,

c) engages in other behaviors that Viktoria considers to be inconsistent with applicable law or general principles of using the Internet or detrimental to Viktoria's good name.

3.5. A person who has been deprived of the right to use the online store may not re-register without Viktoriia's prior consent.

3.6. In order to ensure the security of the transmission of messages and data in connection with the services provided on the Website, the Online Store takes technical and organizational measures appropriate to the degree of threat to the security of the services provided, in particular measures to prevent the acquisition and modification by unauthorized persons of personal data sent on the Internet.

3.7. The customer is obliged in particular to:

a) not to provide or transmit content prohibited by law, e.g. content promoting violence, defamatory or violating personal rights and other rights of third parties,

b) use the Online Store in a way that does not interfere with its functioning, in particular through the use of specific software or devices,

c) not taking actions such as: sending or posting unsolicited commercial information (spam) as part of the Online Store,

d) use the Online Store in a way that is not inconvenient for other customers and for Viktoria,

e) use any content posted as part of the Online Store only for personal use,

f) use the Online Store in a manner consistent with the provisions of the law in force in the territory of the Republic of Poland, the provisions of the Regulations, as well as with the general principles of using the Internet.

IV. The procedure for concluding a Sales Agreement

4.1. In order to conclude a Sales Agreement via the Online Store, you must go to the viktoriia.pl website, select the products, taking further technical steps based on the messages displayed to the Customer and the information available on the website.

4.2. The selection of the ordered Goods by the Customer is made by adding them to the basket.

4.3. When placing an Order - until the "Order" button is pressed - the Customer has the option of modifying the entered data and in the selection of the Goods. To do this, follow the messages displayed to the Customer and the information available on the website.

4.4. After the Customer using the Online Store provides all the necessary data, a summary of the placed Order will be displayed. The summary of the placed Order will contain information on:

a) the subject of the order,

b) the unit and total price of the ordered products or services, including delivery costs and additional costs (if any),

c) selected payment method,

d) the chosen method of delivery.

4.5. In order to send the Order, it is necessary to accept the content of the Regulations, provide personal data marked as mandatory and press the "Confirm purchase" button.

4.6. Sending the Order by the Customer is a declaration of will to conclude a Sales Agreement with Viktoriia, in accordance with the Regulations.

4.7. After placing the Order, the Customer receives an e-mail entitled "Order Confirmation", containing the final confirmation of all essential elements of the Order.

4.8. The contract is considered concluded when the Customer receives the e-mail referred to above.

4.9. The sales contract is concluded in Polish, with the content in accordance with the Regulations.

V. Delivery

5.1. The list of countries to which we deliver our goods can be found on the delivery information page. Delivery takes place to the address indicated by the Customer when placing the Order.

5.2. The delivery of the ordered Goods takes place by post or courier. Delivery costs are listed on our website. In addition, delivery costs will be indicated at the time of placing the Order.

5.3. The delivery date depends on the chosen form of delivery. Information about delivery times can be found on the carriers' websites.

5.4. Customers may access these Regulations at any time via the link on the main page of the viktoriia.pl website, as well as download and print it out.

5.5. Consolidation, security, disclosure and confirmation to the Customer of the relevant provisions of the Agreement for the sale of Goods takes place by sending the Customer to the e-mail address provided and by attaching a document confirming the purchase to the package containing the Goods.

VI. Prices and Payment Methods

6.1. The prices of the Goods are given in Polish zlotys and include all components, including VAT (specifying the rate), customs duties and all other components.

6.2. The customer has the option to pay the price:

a) by transfer to the bank account number,

b) payment in the PayU SA system,

c) payment in the Przelewy24 system,

d) payment in the paynow system.

e) payment by Visa, MasterCard payment card (the credit card is charged at the time of placing the order),

f) upon receipt,

g) deferred payment (7 days) - only for schools, budgetary units and state institutions,

h) payment in the PayPal system,

i) payment in the Revolut system.

VII. Right of withdrawal

Withdrawal from the contract (returns) in relations with CLIENTS who are CONSUMERS:

You have the right to withdraw from this contract within 14 days without giving any reason.

The deadline to withdraw from the contract expires after 14 days from the day on which you came into possession of the item or on which a third party other than the carrier and indicated by you came into possession of the item

To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post, fax or e-mail). The information should be sent to the following address: Viktoriia Tsyhan, Chmielna 2 lok. 31, 00-020 Warszawa or via our form at contact.viktoriia.pl.

In order to meet the deadline to withdraw from the contract, it is enough for you to send information regarding the exercise of your right to withdraw from the contract before the deadline to withdraw from the contract.

Withdrawal from the contract (returns) in relations with CUSTOMERS who are not CONSUMERS (applies to entrepreneurs and institutions):

Regulations on the principles of warranty for defects and quality guarantees in contracts with entrepreneurs are adopted directly in the wording adopted in the Civil Code, Articles 556-581.

Consequences of withdrawing from the contract

If you withdraw from this contract, we will reimburse to you all payments received from you, including the costs of delivering the goods (except for additional costs resulting from the type of delivery chosen by you other than the least expensive type of standard delivery offered by us), immediately and in any event not later than 14 days from the day on which we were informed about your decision to exercise the right to withdraw from this contract. We will refund the payment using the same means of payment that you used in the original transaction, unless you have expressly agreed otherwise; in any case, you will not incur any fees in connection with this return. We may withhold the reimbursement until receipt of the item or until you provide us with proof of its return, whichever occurs first.

Please send back or hand over the item to Viktoriia Tsyhan, Chmielna 2 lok. 31, 00-020 Warsaw, immediately, and in any case not later than 14 days from the day on which you informed us about your withdrawal from this contract. The deadline is met if you send back the item before the period of 14 days has expired. You will have to bear the direct cost of returning the item. You are only responsible for the decrease in the value of the item resulting from using it in a different way than was necessary to establish the nature, characteristics and functioning of the item.

VIII. Complaints about Goods

8.1. Viktoriia as a seller is liable to the Customer who is a consumer within the meaning of art. 22 [1] of the Civil Code, under the warranty for defects to the extent specified in the Civil Code.

8.2. Complaints arising from the violation of the Customer's rights guaranteed by law or under these Regulations should be reported via our contact form contact.viktoriia.pl. Viktoriia undertakes to consider each complaint within 14 days, and if this was not possible, to inform the Customer within this period when the complaint will be considered.

IX. Complaints regarding the provision of electronic services

9.1. Viktoriia takes steps to ensure the proper operation of the Store, to the extent that results from the current technical knowledge and undertakes to remove any irregularities reported by customers within a reasonable time.

9.2. The customer is obliged to immediately notify Viktoriia of any irregularities or interruptions in the functioning of the Online Store website.

9.3. Irregularities related to the functioning of the Store may be reported by the Customer in writing to the following address: Chmielna 2 lok. 31, 00-020 Warsaw or by e-mail at contact.viktoriia.pl.

9.4. In the complaint, the Customer should provide his name and surname, correspondence address, type and date of irregularities related to the functioning of the Store.

9.5. Viktoriia undertakes to consider each complaint within 14 days, and if this was not possible, to inform the Customer within this period when the complaint will be considered.

X. Final Provisions

10.1. Settlement of any disputes arising between Viktoriia and the Customer who is a consumer within the meaning of art. 22 [1] of the Civil Code, shall be submitted to the competent courts in accordance with the provisions of the relevant provisions of the Code of Civil Procedure.

10.2. Settlement of any disputes arising between Viktoriia and the Customer who is not a consumer within the meaning of art. 22 [1] of the Civil Code of the Civil Code, is submitted to the court competent for the seat of Viktoria.

10.3. In matters not covered by these Regulations, the provisions of the Civil Code, the provisions of the Act on the provision of electronic services and other relevant provisions of Polish law shall apply.
